Terms of Service

1. Agreement and Operator

These Terms of Service ("Terms") govern your access to and use of Free AI Generator ("Service"). The Service is operated by "WebSight Group" Ltd. ("Company", "we", "our", "us"). By using the Service, you agree to these Terms.

2. Service Description

Free AI Generator provides AI-powered tools, including image generation, image editing, image upscaling, and image description features. Some features are available free of charge, and some require account access, credits, or a paid subscription.

3. Eligibility and Age Requirements

You must be at least 18 years old to use the Service. By using the Service, you confirm that you are 18 or older and have legal capacity to accept these Terms.

4. Accounts and Access

Certain features require sign-in. You are responsible for all activity under your account and for maintaining account security. We may suspend, restrict, or terminate access at our discretion, with or without prior notice, when we detect abuse, fraud, security risks, or violations of these Terms or applicable law.

Appeals: If you believe your account has been suspended or restricted in error, you may request review by emailing contact@free-ai-generator.com within 30 days. We review appeals in good faith and respond within a reasonable time.

For security and abuse-prevention purposes, we may store account-related technical identifiers, including your latest sign-in IP address.

We reserve the right to withhold, reduce, or not grant signup credits, free-tier benefits, or promotional allowances when our systems detect signals associated with abuse patterns, including but not limited to IP addresses or network characteristics historically associated with high abuse rates. This determination is made automatically and is not a judgment on any individual user. If you believe a restriction has been applied in error, you may contact us at contact@free-ai-generator.com to request human review.

5. Billing, Subscriptions, and Refund Policy

  • Paid plans are billed monthly in USD via Stripe.
  • Subscriptions renew automatically until cancelled through Stripe Billing Portal.
  • Canceling your subscription stops future automatic renewals; paid access continues until the end of the current billing period.
  • Canceling your subscription or deleting your account does not automatically entitle you to a refund for the current billing period, unless required by applicable law or expressly approved by us.
  • As a general rule, subscription and credit package charges are non-refundable.
  • We may review exceptional refund requests at our sole discretion. To request review, email contact@free-ai-generator.com within 30 days of the charge or suspension.
  • Where access is suspended, restricted, or terminated due to a violation of these Terms or applicable law, unused credits and remaining subscription periods are not refundable, except where a refund is required by applicable law.

Digital services and withdrawal rights: if applicable law grants a withdrawal right, by completing checkout you expressly request immediate performance of digital services and acknowledge that this right may be lost once service delivery begins, to the extent permitted by law.

Statutory rights: Nothing in this section limits any mandatory consumer rights you may have under applicable local law.

6. Acceptable Use and Prohibited Content

You must use the Service lawfully and responsibly. The following content is strictly prohibited:

  • Sexually explicit, obscene, or exploitative content of any kind
  • Sexual content involving minors in any form (CSAM)
  • Non-consensual depictions of identifiable real persons
  • Impersonation, fraud, harassment, or defamation of real persons
  • Disinformation designed to deceive the public, including fabricated news imagery
  • Malware, phishing, spam, or abuse of infrastructure
  • Any content that violates applicable law

You are solely and exclusively responsible for all content you generate, download, store, publish, or distribute through or from the Service, including its lawfulness in your jurisdiction and any consequences arising from its use.

7. User Content, Rights, and Responsibility

Your ownership: You keep rights to your prompts, uploaded files, and generated outputs to the extent permitted by applicable law.

Your responsibility: You are solely responsible for all content you submit, generate, publish, or use through the Service, including legal compliance, required permissions, and consequences of use.

Service operation license: You grant us a limited license to process your content only as needed to provide, secure, and improve the Service.

Retention for operation and enforcement: We may retain copies of prompts, uploaded files, outputs, and related metadata for account history, service continuity, analytics, abuse prevention, debugging, enforcement, legal claims, and compliance, as described in the Privacy Policy and to the extent permitted by applicable law.

8. Our Intellectual Property

The Service software, website content, branding, and related technology are owned by or licensed to "WebSight Group" Ltd. and are protected by intellectual property laws. These Terms do not transfer ownership of our technology or brand assets to you.

9. AI Output Disclaimer

AI outputs may be inaccurate, incomplete, or unsuitable for specific use cases. You are responsible for reviewing and validating outputs before relying on them in personal, commercial, legal, medical, or safety-critical contexts.

10. Third-Party Services

The Service relies on third-party providers (including AI, storage/CDN, hosting, analytics, authentication, and payment services). Your use of those components may also be subject to their terms and policies.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, business, or goodwill arising out of or related to your use of the Service.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria. Any dispute arising from or in connection with these Terms or the Service is subject to the competent courts in Sofia, Bulgaria, unless mandatory consumer protection law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. The updated version becomes effective when posted on this page with a revised "Last Updated" date. Continued use of the Service after an update means you accept the revised Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
